As there isn't enough evidence to get a conviction the driver is going to be written a letter & ECAN are going to have a chat to him

Yes, on the face of it, this seems a poor outcome, but in the circumstances it's probably best.
Looks like folk need to get evidence of morons actually on top of the colony area, leaving squashed eggs and nests behind as occurred in the Ashburton case. There, the offender was arrested parked in the middle of the gulls, probably where he had become stuck in the shingle.
